Subscription Mail-Order Cash-Pay Pharmacy Service (California Residents Only)

1. Overview
These Terms and Conditions (“Terms”) govern your enrollment in and use of the Cedarmak Pharmacy subscription-based mail-order pharmacy program (“Service”). The Service provides eligible subscribers access to select generic medications for a flat monthly fee. By enrolling, you acknowledge that you have read and agree to these Terms.

2. Eligibility
To enroll, you must:

Be at least 18 years old.

Be a current resident of California.
-
Have a valid prescription issued by a licensed U.S. healthcare provider.

Not be enrolled in or seeking to use the Service in connection with any government-funded health program (including but not limited to Medicare, Medicaid, Medi-Cal, VA/Tricare, or other federal/state health benefits).
Insurance is not used or billed for this Service. The Service is a cash-pay program. Prescriptions filled under the Service are not submitted to insurance and do not apply toward insurance deductibles or out-of-pocket maximums.

3. Subscription Plan and Authorized Use

The subscription fee is $29.99 per month, billed automatically.

The plan includes up to five (5) eligible generic prescriptions per month, each limited to a 30-day supply, selected from the program formulary.

Formulary availability may change at any time based on clinical, regulatory, or supply-chain considerations.
The subscription is personal to the enrolled individual. Prescriptions must match the subscriber’s legal name and date of birth. Any prescription that does not match will be processed at standard cash pricing.
The Service does not guarantee medication availability, specific manufacturers, or uninterrupted supply. If, after enrollment, a subscriber is determined to have no eligible prescriptions under the Service or does not meet eligibility requirements, Cedarmak Pharmacy may cancel the subscription. In such cases, the Pharmacy may issue a prorated or full refund at its discretion, unless otherwise required by law.
4. Prescription Requirements

A valid prescription must be received and verified before dispensing.

Cedarmak Pharmacy may contact your prescriber to confirm prescription validity, dosage, or clinical appropriateness.

All prescriptions are reviewed by a licensed pharmacist in accordance with California law.
The Service does not provide medical advice. Clinical decisions regarding dispensing are made solely by pharmacists exercising independent professional judgment.
5. Medication Fulfillment and Shipping

All medications are dispensed by a licensed California pharmacy.

Orders generally ship within 1–3 business days, subject to medication availability and prescriber responsiveness.

Only FDA-approved manufacturers are used where available.

Shipping times are estimates and may be affected by external factors.
Risk of Loss:
Risk of loss transfers to the subscriber upon confirmed delivery scan by the carrier. The Pharmacy is not responsible for stolen packages after confirmed delivery, except where required by law.
Subscribers are responsible for ensuring a secure delivery location.

6. Service Limits and Restrictions
The following are excluded from the Service:

Controlled substances

Brand-name medications
-
Specialty medications
-
Refrigerated or temperature-controlled items
-
Drugs requiring special handling or regulatory restrictions
Pharmacists may impose quantity limits or decline to dispense medications inconsistent with clinical guidelines or patient safety.

7. Subscriber Responsibilities
Subscribers agree to:

Provide accurate and up-to-date personal, prescription-related, and payment information.

Maintain a current mailing address and notify the Pharmacy of any changes.

Provide valid prescriptions and comply with all laws governing prescription use.

Ensure someone is available to receive medications at the delivery address.
Misuse of the Service may result in immediate termination.

8. Payment, Billing, and Automatic Renewal (ARL-Compliant)
By enrolling, you authorize Cedarmak Pharmacy to charge the monthly subscription fee to your selected payment method on a recurring basis until you cancel.
Disclosures Required by California Automatic Renewal Law:

Your subscription automatically renews each month unless you cancel.

You may cancel at any time using one of the methods listed in Section 9.

You will receive a post-purchase acknowledgment confirming your enrollment, renewal terms, and cancellation methods.
Subscription fees are non-refundable, including for partial billing periods, except where required by law or expressly permitted under these Terms.

9. Cancellation
You may cancel at any time through:

Your online account (if available)

Emailing customer support at: info@cedarmak.com

Calling the customer service number provided on your enrollment receipt
Your cancellation becomes effective at the end of the current billing cycle. You will receive written confirmation of cancellation as required by California law.
After cancellation, no further charges will be made unless you re-enroll.

10. Compliance and Legal Notices

The Pharmacy complies with all applicable federal and California pharmacy laws.

The Service is not a substitute for medical care, diagnosis, or treatment.

Pharmacists may refuse to dispense medications when clinically inappropriate or unsafe.

The Service is not health insurance and does not replace health insurance coverage.

11. Privacy
Your personal and health information is handled in accordance with:

HIPAA

California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA)

Applicable consumer health data laws
Please refer to the Cedarmak Pharmacy Privacy Policy, incorporated by reference into these Terms.

12. Changes to the Service or Terms
Cedarmak Pharmacy may modify these Terms or the formulary at any time. Updated Terms will be posted on the website and will apply prospectively. Continued use of the Service after the effective date constitutes acceptance.
Material changes to automatic renewal terms will be communicated as required by California law.

13. Limitation of Liability
To the fullest extent permitted by law:

Cedarmak Pharmacy is not liable for indirect, incidental, special, or consequential damages.

Liability for any claim is limited to the fees paid by the subscriber during the three (3) months preceding the claim.

The Pharmacy is not responsible for:
• Courier delays
• Stolen packages after confirmed delivery
• Medication shortages
• Prescriber inaction or unresponsiveness
• Subscriber misuse of medications or failure to follow instructions
Nothing in these Terms limits liability where prohibited by law.

14. Governing Law
These Terms are governed by the laws of the State of California.
